Regulation of the Minister of Health Number 38 of 2016 concerning Organ
Transplantation fills the legal gap related to the requirements and procedures for
organ and/or tissue transplantation. Following up on Law Number 17 of 2023, the
government then issued implementing regulations, namely Government Regulation
Number 28 of 2024 concerning Implementing Regulations. There are 31 implementing
regulations related to health that have been revoked and declared invalid. The problem is
increasingly complex regarding the legal status of the Minister of Health Regulation on
Organ Transplantation, considering that both Law Number 17 of 2023 and Government
Regulation Number 28 of 2024 do not explicitly revoke it. In the event that the new law
does not explicitly revoke it, the Ministerial Regulation is still considered valid. On the
other hand, it is very possible that the substance of the Ministerial Regulation will become
irrelevant or even conflict with the new law. This study aims to scientifically examine
both theoretical and legal perspectives on the legal status of implementing regulations
after the law is revoked. The type of research used in this study is normative research
using the Statute Approach and the conceptual approach. The results of this study are
that the legal status of the Minister of Health Regulation on Organ Transplantation
after the enactment of Law Number 17 of 2023 and PP Number 28 of 2024 is materially
no longer legally binding. This is because the provisions of the material content of the
Minister of Health Regulation on Organ Transplantation to implement the law are no
longer relevant and the law that is the legal basis for its formation, namely Law of the Republic of Indonesia Number 36 of 2009 concerning Health, has been revoked. The urgency
of the ratification of law number 17 of 2023 to be a means of encouraging the readiness of the
indonesian health sector in facing the current and future health crises. However, since the process
of drafting, discussing, and ratifying it is considered not to have paid attention to the principles
of forming laws and regulations, especially the princple of legal certainty.
